Terms and Conditions – Booking Cars

Our terms and conditions apply to every booking you make with us or through this website. It is therefore important that you fully understand these terms and conditions.

Cancellation Policy

If you wish to cancel your reservation, you may request a 50% refund up to 4 weeks before your scheduled arrival date.

Minimum Age

The driver must be at least 23 years old and must have held a valid driver's license for at least 1 year.

A standard insurance excess (deductible) of USD 450 applies.

You can choose to waive the insurance excess for an additional daily fee. The amount depends on the type of vehicle you rent. For small cars, the fee is €10 per day, while for larger vehicles it can be up to €25 per day.

If you purchase the excess waiver, no security deposit is required.

If you are under 23 years old, please contact us to discuss the available options.

Returning the Vehicle

The vehicle must be returned in the same condition in which it was received, including all accessories, spare tire, and tools.

The vehicle must be clean and returned with the same fuel level as at the start of the rental period.

Damage and Theft

In the event of theft of the vehicle, its parts, or accessories, the renter may be held responsible for the associated costs up to the maximum amount of the applicable insurance excess.

Booking Cars is not responsible for any personal belongings or valuables left inside the vehicle.

Any minor damage, glass damage, and loss of rental days resulting from repairs will be deducted from the security deposit.

The security deposit will remain under the control of Booking Cars until all damage-related matters have been fully resolved.

The security deposit may never be used as an advance payment toward the rental fee.

The renter is also responsible for damage caused without their knowledge.

The renter is fully liable for damage resulting from ignoring dashboard warning lights or temperature gauges, as well as damage caused intentionally, through conditional intent, or with the renter's consent.

Vehicle Keys

If you lose your vehicle key, or if it becomes wet due to exposure to seawater or moisture while kept in your pocket and consequently stops functioning, you will be fully responsible for all associated costs.

This is not covered by the all-risk insurance policy.

Off-Road Driving

Our vehicles are insured for use on public roads only.

Any damage or excessive dirt resulting from off-road driving is entirely the responsibility of the renter.

In such cases, at least the full security deposit will be withheld.

If an inspection determines that the damage exceeds the security deposit paid, the renter will be charged for the additional costs.

Exception:

Off-road driving is permitted with our Jeep Wranglers.

Liability for Personal Injury

The renter indemnifies Booking Cars Curaçao against all liability for damage and/or injury caused to goods and/or persons transported in the rented vehicle.

Any costs relating to damage and/or injury caused to third parties that exceed the insured amount of €75,000 will be the responsibility of the renter.

Vehicle Security and Accidents

When leaving the vehicle unattended, the renter must remove the key, lock the vehicle, and activate the anti-theft security system.

In the event of a malfunction or damage, the renter must contact Booking Cars as soon as possible.

Costs incurred for repairs or malfunctions resolved independently by the renter cannot be charged to Booking Cars.

Flat tires are the responsibility of the renter.

The renter is responsible for arranging tire replacement and repairs, including the repair fee of €7.50.

If you have purchased additional tire insurance, all associated costs will be covered by Booking Cars.

This optional insurance can be selected during the booking process.

In the Event of Damage or an Accident

Do not move the vehicle.

The renter is required to obtain an official accident report from Curaçao Road Service and must refrain from making any statements or commitments regarding liability.

Failure to comply with these requirements will result in the renter being held fully responsible for the damage.

The insurance excess applies separately to each incident or damage claim.

Immediate Steps in the Event of Damage or an Accident

1. Ensure Safety and Check for Injuries

Check whether anyone has been injured.

In the event of a medical emergency or injuries, immediately call an ambulance by dialing 912 or contact the emergency services.

2. Do Not Move the Vehicle

Leave the vehicles exactly where they came to rest following the collision.

This is required for evidence collection and insurance purposes.

Take photographs of the accident scene. Only move the vehicle if urgently necessary for road safety.

3. Contact ForenSys

Call ForenSys (formerly Curaçao Road Service / CRS) using one of the following numbers:

  • Telephone: 9233

  • Toll-free: 0800 1199

  • WhatsApp: +5999 461 3282

ForenSys will come to the accident location, take photographs, document the incident, and prepare an official accident report.

Without this report, the insurance company may refuse to cover the damage.

4. Avoid Arguments

Remain calm and do not argue with the other party about who is responsible for the accident.

Leave the determination of liability to the appropriate authorities.

Follow-Up Steps

1. Notify the Car Rental Company

If you are driving one of our rental vehicles, contact Booking Cars immediately.

Telephone / WhatsApp: +5999 693 2701

2. Insurance and Evidence

Collect the contact and insurance details of the other party involved.

Take photographs of the accident scene and contact your travel insurance or car insurance provider if applicable.

Use of the Vehicle

The renter is not permitted to:

  • Use the vehicle for purposes other than private use.

  • Drive the vehicle while in a condition that makes driving legally prohibited, including being medically or otherwise unfit to operate a motor vehicle.

Alcohol and Drug Use

Any damage resulting from driving under the influence of alcohol and/or drugs is entirely the responsibility of the renter.

Driver and Additional Drivers

The vehicle may only be driven by the person named as the renter.

Additional drivers are permitted only if Booking Cars has recorded their driver's license details and has explicitly authorized them to drive the vehicle.

Rental Payment

The rental fee must be paid in advance.

Each rental day covers a period of 24 hours.

The rental period begins at the time for which the vehicle has been reserved for the renter.

If the vehicle is returned late, an additional charge of €10 applies for the first hour.

After the first hour, the full daily rental rate will be charged.

Any debt collection costs will be the responsibility of the renter.

Early Returns and Failure to Return the Vehicle

No refund will be provided if the vehicle is returned before the end of the reserved rental period.

If the vehicle is not returned, all costs associated with recovering the vehicle will be charged to the renter.

Driving Conduct

The vehicle must be driven in accordance with all applicable local traffic laws and regulations.

Any costs resulting from violations of these laws and regulations will be the responsibility of the renter.

Consequences of Violating the Terms and Conditions

If the renter fails to comply with any of the above terms and conditions, all resulting consequences and costs will be the responsibility of the renter.

In the event of a breach of contract, Booking Cars reserves the right to immediately repossess the vehicle without refunding any prepaid rental fees.

In situations not specifically covered by these terms and conditions, Booking Cars reserves the right to make the final decision.
